(Last modified: May 4, 2017)

Twisted Pixel Games LLC (“Company” or “we”, “us” or similar terms) respects your privacy and is committed to protecting it through our compliance with this Supplemental Privacy Policy.

  1. How This Privacy Policy Applies

This Supplemental Privacy Policy describes the types of information that may be collected from you, or that you may provide, in connection with your access to or use of (i) the Wilson’s Heart website located at www.wilsonsheart.com (the “Site”) and (ii) any features, functionality, information or services (including content and material) made available by or on behalf of us through the Site (clauses (i) and (ii), collectively, the “Site Services”), and our practices for collecting, using, maintaining, protecting and disclosing that information.

This Supplemental Privacy Policy is made up of (i) our Privacy Policy, which can be found at www.twistedpixelgames.com/privacy-policy, and which is incorporated herein by this reference and (ii) the terms and conditions set forth herein which set forth supplemental terms to our Privacy Policy that are specific to the collection and use of information that you may provide through, or may be collected by, your use of and access to the Site Services. In the event of a conflict between the terms and conditions set forth herein and those set forth in the Privacy Policy, the terms and conditions set forth herein will take precedence with respect to your use of and access to the Site Services.

Please read this Supplemental Privacy Policy (including our Privacy Policy) carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use the Site Services. By accessing or using the Site Services, you agree to this Supplemental Privacy Policy. This Supplemental Privacy Policy may change from time to time (see Section 3 (Changes to our Supplemental Privacy Policy)). Our Privacy Policy is subject to change as described in the Privacy Policy.

  2. Certain Automatic Data Collection Technologies; Third Party Use of Such Information

As the distributor of our Wilson’s Heart video game (the “Game”), we work with Oculus VR, LLC (“Oculus”) to administer certain aspects of the Site Services. This includes permitting Oculus to work directly with third-party providers who provide analytics, marketing, remarketing, advertising or social networking services with respect to the Site Services and/or the Game. These third-party providers (including Google) may use cookies, alone or in conjunction with web beacons or other tracking technologies, to collect information about you, including your unique identifier(s), location, browser settings, and certain purchase activities (including items and amounts purchased). This automatically collected information does not include personal information, but such information may be maintained or associated with personal information collected in other ways by such third-party providers or Oculus. This automatically collected information may be shared by the third-party providers directly with Oculus and it is our understanding that it may be used by Oculus or the providers (such as Google, Facebook or Twitter) for purposes of identifying you when you visit other websites or platforms, providing you with targeted advertisements and other content (including advertisements relating to the Game) on other websites or platforms (including Google, Facebook or Twitter) based on your past interactions with the Site Services, tracking and measuring marketing campaigns and conversion rates, and, in the case of Oculus, otherwise engaging in other activities consistent with Oculus’s then-current applicable privacy policy. We do not control how Oculus or the third-party providers themselves use or disclose the information they collected from or about you, nor is Oculus’ or any such provider’s use or disclosure of such information subject to any restrictions on use or disclosure imposed on us under the Privacy Policy. To the extent that Oculus or the relevant third-party provider provides us with any of the automatically collected information described above, then we will only use and disclose that information consistent with our Privacy Policy.
